Mitch McConnell has been out of public view for more than five weeks following his hospitalization. His office released a written statement and photograph, but there have been no live appearances or direct public communications from the senator himself. That raises a much larger constitutional question: What happens when a sitting U.S. senator is alive but potentially unable to perform the job? The answer is disturbing. A prolonged incapacity does not automatically create a vacancy, and the Senate has no established process for declaring the seat of a living but incapacitated senator vacant.
